Commercial, Contract, Company and Insolvency Law

Paul has appeared as sole counsel in the High Court and County Court and acted both for and against corporations.

He is regularly instructed to advise and draft statements of case on a variety of commercial litigation matters, and to provide strategic planning and development advice to start-ups and established businesses alike.

He often works alongside clients’ technology teams so they can implement solutions that accurately reflect the legal requirements he advises on.

Paul’s experience includes:

  • Representing clients, at first instance and on appeal, in actions for the sale and supply of defective goods and services, misrepresentation, repudiation of contract, payment default, director disputes and intellectual property disputes, among other matters.
  • Advising on a complex shareholder dispute involving claims for breach of contract and allegations of fraud among six companies spanning three countries.
  • Advising on a whistleblowing claim for unauthorised acts causing serious damage and misuse of data under the Computer Misuse Act 1990 and GDPR.

Virtual assets and cryptoassets

Paul is a leading junior in cryptoasset advice and recovery.

He is well-versed on the regulatory and compliance requirements of tokens including non-fungible tokens (NFTs) and initial coin offering (ICO) drops. He is regularly called upon to advise clients on the regulatory taxonomy of tokens and is known by clients for his sharp attention to the technical detail, which can be critical to determining if a novel fintech proposition falls to be regulated or not, and focus on providing actionable recommendations.

Paul’s experience includes:

  • Advising on the tokenisation of a £400m property portfolio and the associated digital trading platform.
  • Advising on injunctive relief and recovery of funds from a cryptocurrency trading and liquidity platform.
  • Advising on the design and implementation of staking protocols for a novel cryptoasset class and ICO.
  • Advising on an NFT sale for a massively multi-player online game.
  • Assisting and advising victims of crypto fraud in the recovery of their stolen funds.

Blockchain, data and privacy

Paul has appeared before courts and tribunals for claims involving breaches of the UK GDPR and actions for the misuse of private information and breach of confidence.

Paul also regularly advises clients on data models and data transfer protocols, particularly those involving blockchain, to ensure regulatory compliance.

Paul’s experience includes:

  • Advising in a group action for the misuse of 400 celebrities’ personal data by means of his analysis of image rights contracts and data usage practices to identify potential data breaches and rights violations.
  • Successfully acting on behalf of the defendant in a claim against them for misuse of their customer’s personal data and image rights on social media.
  • Successfully defending against a claim for breach of the Data Protection Acts 1998 and 2018 for the disclosure of customer financial data.
  • Advising on an injunction and on cross-jurisdictional enforcement issues for a defamation claim involving libellous posts made on social media and in other online channels and forums.
  • Advising on a data breach and misuse of personal information claim following an employer’s surveillance of an employee without their knowledge or consent.

Artificial Intelligence and Biometrics

Paul’s experience includes:

  • Advising on a claim for breach of contract, breach of confidence, breach of fiduciary duty and infringement of copyright for a company specialising in artificial intelligence technology. Paul’s knowledge of software development procedures and common licensing rights was key to developing the claim strategy.
  • Advising on a representative action in a claim against a technology company for its misuse of biometric data and personal identity recognition algorithms.
